Even if certain situations concerning the digital society may fall within the scope of rights recognised by the CFREU, given their broad formulation, the approval of an “European Union Charter of Digital Rights” seems the best solution to protect digital rights nowadays. This Charter would be a useful tool to define the system of rights protection in a more sophisticated and up-to-date way, offering the Court of Justice a precise benchmark.
