ABSTRACT Times are ready to the digitisation of public contracts: the new Italian Public Contracts Code regulates it, providing a discipline of principles. This study intends to examine the digitisation in the new Public Contracts Code, starting from its roots. More in detail, the focus of this study is to analyze the principles of digitisation in public contracts and, specifically, those to be applied when taking automated decisions. Then the study aims also to understand which are the true novelties of the discipline on digitisation in public contracts of the new Code and which challenges and opportunities this new discipline brings and faces.
